Revised Notice of Public Hearing—Hayward City Council

NOTICE IS HEREBY GIVEN that the City Council of the City of Hayward, at its meeting on Tuesday, September 15, 2020, will hold a public hearing required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), will be held with respect to a proposed plan of financing providing for the issuance by the California Municipal Finance Authority (the "Authority") of its revenue bonds in one or more series issued from time to time, including bonds issued to refund such revenue bonds in one or more series from time to time, in an amount not to exceed $29,000,000 (the "Bonds") for the benefit of California Crosspoint High School, d/b/a California Crosspoint Academy (the “Borrower”). The Borrower is a California nonprofit public benefit corporation and an organization described in Section 501(c)(3) of the Code. The Bonds will be issued as “qualified 501(c)(3) bonds” under Section 145 of the Code. 

The Authority will loan the proceeds of the Bonds to the Borrower to be used to: (1) finance and/or refinance the acquisition, construction, installation, improvement, furnishing and equipping of certain educational facilities, including but not limited to (a) an existing two-story educational building, containing classrooms, a learning resource center, and administrative facilities, (b) a new multi-story building containing classrooms and other instructional and administrative spaces, as well as student residence facilities, (c) a new building containing a multi-purpose assembly hall, commercial kitchen, gymnasium, fitness center, and other recreational and exercise facilities, and (d) related and appurtenant facilities, landscaping, and site improvements, all to be located on a 5.5 acre site at or adjacent to 25500 Industrial Boulevard, Hayward, California (the “Facilities”); (2) pay costs of issuance of the Bonds, (3) fund all or a portion of a debt service reserve fund deposit, capitalized interest, and related working capital (collectively, the “Project”). The Facilities are to be owned and operated by the Borrower as an independent nonprofit school educating both boarding and day students.

PLEASE TAKE NOTICE that if you file a lawsuit challenging any final decision on the subject of this notice, the issues in the lawsuit may be limited to the issues which were raised at the City's public hearing or presented in writing to the City Clerk at or before the public hearing. By Resolution the City Council has imposed the 90-day time deadline set forth in C.C.P. Section 1094.6 for filing of any lawsuit challenging final action on an item which is subject to C.C.P. Section 1094.5.
