Minor Temporary Use Permit

In Spring 2026, the City Council approved a policy allowing specified temporary uses that are conducted outdoors to be granted a Minor Temporary Use Permit (MTUP). Because of the nonpermanent status and unusual characteristics, minor temporary use permits require special consideration so they may be located properly with respect to their effects on surrounding properties and uses. MTUP review considers land use, parking, noise, and other factors for temporary uses and ensures potential negative impacts on surrounding properties and uses are addressed by imposing reasonable conditions of approval. These conditions of approval aim to balance the request of the applicant with the public health, safety, and welfare of the surrounding properties and uses. 

Applications shall be submitted directly through the Hayward e-Permit Portal. 

Submitting an Application:

  1. Contact a City of Hayward Planner: Contact a planner by emailing planning.division@hayward-ca.gov or calling (510) 583-4216 to determine if your proposed temporary use is eligible, required entitlements, and submittal materials. 
  2. Register for an e-Permit Portal account: You must be a registered user of the Hayward e-Permit Portal before you can submit your application. Learn more about how to register on our e-Permit Portal help page.
  3. Apply for your Plan Type: Using the e-Permit Portal, apply for your MTUP by completing the application and attached the required submittal materials. Learn more about how to apply for a Plan on our  e-Permit Portal help page.

Required Submittal Materials:

The submittal items below are required for Minor Temporary Use Permits. Please note additional submittal items may be required depending on the project scope.

  • Photographs: Photographs of existing site conditions.
  • Owner Authorization Form: Only required if the applicant is not the property owner. (See Owner Authorization Form in Handouts). 
  • Business and Operation Plan: A letter which describes the proposed business operations and specified term of use (not to exceed six months in a calendar year). Please clearly state hours of operation, number of employees, and if applicable, provide the number of attendees at any one time including during peak and off-peak times, any vehicles stored on-site and their respective quantities and sizes and/or any other pertinent information related to the operations of the proposed use.  
  • Architectural Plans: Site plans (including waste station locations), elevations, and project data. (See Development Permit Checklist in Handouts for specifics)

Project Review:

Applicants will be notified by email or can login to the e-Permit Portal for updates on their application. MTUPs typically take one month to process. Estimated processing times do not include the time needed by the applicant to revise and resubmit their application. 

Paying Fees:

After submitting your application through the e-Permits Portal, the applicant will be promoted to pay the associated fees. The application fee for a MTUP is $747.
